1. Acceptance of Terms & Scope

Welcome to Ozgo Gallery (operated by Ozgo Productions Ltd, referred to herein as "Ozgo Gallery", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the website located at gallery.ozgo.co.uk, including all subdomains, creator storefronts (/g/[slug]), client proofing portals, global search engines, and digital commerce services (collectively, the "Service").

By visiting, browsing, registering for an account, purchasing digital media licenses, commissioning physical fine art prints, or uploading visual content to the Service, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and agree to be legally bound by these Terms, our Privacy Policy, and any incorporated license agreements.

2. Description of the Platform & User Roles

Ozgo Gallery is a premier visual commerce and portfolio ecosystem supporting **filmmakers, videographers, drone cinematographers, visual artists, and photographers** ("Creators" or "Sellers"), as well as **commercial clients, agencies, and individual buyers** ("Buyers" or "Clients").

• Creator Storefronts & Portfolios: Creators can publish custom-branded storefronts, organize video and photo galleries, configure tiered digital licensing, set pricing, and manage client proofing workflows.
• Digital Media Marketplace: Buyers can discover, preview with 10% transparent watermarking, and license 4K Ultra HD video masters, 1080p clips, and high-resolution fine-art photography.
• Client Proofing Portals: Private or public proofing portals enabling clients to star, heart, and leave frame-accurate retouching notes against target quotas.
• Physical Fine-Art Print Fulfillment: Automated laboratory drop-shipping of museum-grade canvas prints, framed wall art, and photographic paper prints via our global print lab partner, Prodigi.

3. Account Registration, MFA Security & Tiers

To upload content, manage galleries, or sell digital licenses, you must register for a Creator Account. You agree to provide accurate, current, and complete information and promptly update it as necessary.

Multi-Factor Authentication (MFA / 2FA): For enhanced security, creator accounts support Multi-Factor Authentication using automated 6-digit email verification codes. You are responsible for safeguarding your credentials and notifying us immediately at security@ozgo.co.uk if you suspect unauthorized access.

4. Intellectual Property & Creator Representations

Creator Copyright Retention: Creators, filmmakers, and photographers retain 100% of their intellectual property, copyright, and moral rights in all video footage, drone captures, and photograph master files uploaded to the platform. Ozgo Gallery claims zero ownership over your artistic works.

Platform Hosting License: By uploading content, you grant Ozgo Gallery a worldwide, non-exclusive, royalty-free license strictly to host, transcode (generate 720p/480p FastStart preview streams and thumbnails), overlay our subtle 10% preview watermarks, and deliver uncompressed master files to authorized purchasers upon completed payment.

Creator Warranties: You represent and warrant that:

• You own or hold all required intellectual property rights, licenses, and permissions for all uploaded audio, video, and imagery.
• All aerial drone footage was captured in compliance with civil aviation regulations (e.g. CAA / FAA) and air safety standards.
• You have secured appropriate model releases and property releases where necessary for commercial licensing.
• Uploaded materials do not infringe upon any third-party copyright, trademark, privacy, or publicity rights.

5. Standardized Digital Media Licenses (Buyer Terms)

When purchasing digital master files from any gallery on our platform, the Buyer is granted a non-exclusive, non-transferable, worldwide license according to the selected tier:

*All digital licenses are perpetual (lifetime, never expire) once purchased. Raw master files may not be resold as standalone stock clips or used to train artificial intelligence models without the creator's express written consent.

6. E-Commerce, Stripe Connect Payouts & Commission

All digital transactions and subscription billings are processed securely via **Stripe**. Creator payouts are disbursed directly to the creator's connected bank account via Stripe Connect Express.

• Platform Fee Deductions: Platform commissions (15% on Free Starter, 5% on Pro, 0% on Enterprise) and Stripe processing fees are automatically deducted at the moment of customer checkout.
• Currency & Taxes: Primary prices are listed in Great British Pounds (GBP / £). Creators are solely responsible for all local tax obligations, VAT, and income disclosures arising from their earnings.
• Digital Refunds: Because uncompressed master video files and high-resolution photo files unlock immediately upon purchase, digital sales are final and non-refundable once downloaded, except in cases of verified file corruption.

7. Legacy Library Retention Policy (Upon Downgrade)

We respect your creative output and will never delete or purge your uploaded master footage when your subscription changes.

• 15% Commission Rate: The platform sales commission automatically adjusts to the standard Free Tier rate of 15% to support ongoing cloud storage and CDN bandwidth costs.
• Upload Freeze: Uploading new video clips, photos, or creating new galleries is paused until the creator upgrades back to the appropriate tier (or deletes storage to ≤ 5 GB).
• Public Marketplace Requirement: Over-quota legacy galleries hosted on the Free tier must remain Public and listed in the global marketplace catalog to enable ongoing digital sales. Over-quota libraries cannot be set to private/unlisted vaults on the Free tier.

8. Physical Print Fulfillment & Prodigi Print Lab

Physical fine-art prints, framed canvas, and wall art products are custom manufactured on-demand and drop-shipped globally by our production partner, **Prodigi Group**.

• Shipping timelines and courier tracking are provided upon print lab dispatch.
• Because physical prints are bespoke custom-manufactured products, cancellations are only possible prior to lab printing.
• In the rare event of transit damage or manufacturing defects, buyers must report the issue within 14 days of receipt to support@ozgo.co.uk with photographic evidence for an expedited free replacement.

9. Acceptable Use & DMCA Copyright Takedowns

You agree not to upload, store, or distribute any content that is unlawful, pornographic, defamatory, abusive, or infringing upon third-party intellectual property rights.

Notice & Takedown Procedure: If you believe content on our platform infringes your copyright, please send a formal DMCA notice to copyright@ozgo.co.uk containing:

1. Identification of the copyrighted work claimed to be infringed.
2. Exact URL / gallery location of the infringing material.
3. Your contact information and a statement of good faith belief.
4. Your electronic or physical signature.
